Judge Becerra has, in my experience, demonstrated conduct that raises serious concerns regarding judicial temperament and impartiality. On multiple occasions, she appeared unfamiliar with the legal briefing and factual background prior to hearings, yet formed strong opinions without engaging with the substance of the arguments. During oral argument, she did not provide a meaningful opportunity to be heard and was dismissive in tone, sometimes openly expressing skepticism in a way that felt personal and unprofessional.
Her demeanor at hearings has included laughter at counsel’s statements and comments suggesting disbelief in the sincerity of positions taken, rather than addressing them on the merits. This conduct undermines the decorum expected in federal proceedings and reflects a lack of the judicial neutrality that parties are entitled to. Practitioners unfamiliar to her courtroom may find the experience particularly difficult, especially when opposed by local counsel she sees regularly.
In my view, Judge Becerra’s courtroom conduct falls short of the standards expected of a federal judge, and attorneys appearing before her should prepare with extra care and caution.
