I am writing to formally express concerns regarding the actions of former Chief Judge Timothy C. Batten, which I believe represent a significant injustice within our legal system, particularly concerning the treatment of African American individuals and businesses. The case PureO v. Loc N Products, Case No. 23-cv-03917, exemplifies a troubling pattern of misconduct that merits scrutiny.
In this case, Judge Batten denied over 400 ownership exhibits presented by our company, which fundamentally undermined our defense and created an unjust record of no contest. This ruling resulted in a summary judgment in favor of a Nigerian company, effectively transferring ownership of our brand without due process. According to established legal principles, as articulated in Lennon v. Sweeney, 101 F.3d 777 (11th Cir. 1996), summary judgments are permissible only in instances where there is a clear failure to respond to the complaint or when there is no genuine issue of material fact. The evidence we provided was substantial, and the dismissal of our exhibits raises serious concerns about the integrity of the judicial process.
Furthermore, it has come to light that Judge Batten may have made these determinations based on prior assurances made to the Nigerian company and their legal representatives from Alston & Bird, specifically regarding the avoidance of a jury trial. This raises significant ethical questions under the Code of Conduct for United States Judges, which mandates that judges must avoid impropriety and the appearance of impropriety in all activities.
Our commitment to preserving our Black-owned brand is unwavering, and we believe that the actions taken in this case reflect broader systemic issues within our judiciary that must be addressed. The retirement of Judge Batten, reportedly in response to complaints filed with the Department of Justice (DOJ), indicates an acknowledgment of the seriousness of these allegations.
We respectfully seek justice and a thorough investigation into these matters to ensure accountability and uphold the principles of fairness and equality within our legal system.

It serves as an injustice to our entire legal system for everyone to remain silent and fearful to reort and halt the many years of misconduct and disregard of African Americans by former Chief Judge Timothy C. Batten as continues by view of the PureO v Loc N Products trademark infringement case, case, no. 23-cv-03917 is a case where this judge boldly refused over 400 of our ownership exhibits to create a record of no contest by us blacks and award our company to a Nigerian company by his ruling of summary judgment and default judgement. The law only allows such rulings if we failed to respond to the complaint or there was evidence of no dispute.
Judge Batten arrived at such rulings based on his promise to the Nigerian company and Alston and Bird lawyers of "no jury trial". We will not give up our fight for our black owned brad name. We seek justice. This judge has since retired in fear of our complaints to the DOJ to avoid sanctions while acting as a Chief Judge.

Re: Now retired (possibly resigned by force) Chief Judge Timothy C. Batten. Prior to this judge's May 23 retirement he has maliciously followed his side deal with opposing parties in our case to assure that no jury trial is held and awarded our black owned business to the Nigerian and Korean corporations who falsely filed claims stating that they created our black owned brand name Loc N--a name created for us with dreadlocks and twist styles of hair. In our last hearing they mocked us black pro se parties in court with racists comments and after the hearing they told us that writing the Department of Justice on them will serve no purpose because they "run the DOJ". All on court hallway cameras. This judge is a sad sad very sad disgrace to all of our great upstanding officials who make it their duty to serve the public and always be fair and not allow racism or favors or other personal gains to infect their duty under no circumstance. He needs to be investigated and charged immediately as well as the officials who aid such conduct. We are a greater country when we quickly resolve situations like this before the publics watching eyes.

I am a black pro se litigant and I am fearful and shocked that this judge who has threatened me to dismiss my own civil cases against his lawyer friends at Alston and Bird. Herefused to read or know my case facts while ruling in ways to grant ownership of my black owned Loc N Products business to the big corporate lawyer and Korean and Nigerian clients. He specializes in aiding corporate in stealing black and minority businesses while assuring they duck a civil trial by his order of default or summary judgment rulings that can close the case in corporate favor. It is unheard of that after 18 months of us crying out that he still is over the 2023 case and that he put himself over my two pro se civil cases where I sued the fraudulent and corrupt lawyers and Nigerians and Koreans. He outright stated that if I do not dismiss my two October 2024 civil cases against the lawyers and fraudsters whole stole my black business that he is locking me up until I dismiss my civil cases. He even threatened me to withdraw my trademark application for my brand name Loc N Products or go to jail. I wil not do that as prison is worth fighting for my business and it has been months now and he has not locked me up. It was a threat bluff that he had no legal justification to carry out. Anyone can call me because he needs to be off of that bench and charged. This above is only 25% of what he has done to us black pro se business owners. gwilliamsgee@gmail.com. At first I was impresseed, but quickly I realized this judge is extremely biased, unfair. the opposite of what I think a judge should be. Very Sad!

He is a very intemperate judge with a propensity of a pro corporate bias. One of the best examples of why tenure should not be granted for Federal District Judges and a continual 5 year review period should be established to score judges on merit.

Judge Batten is a credit to the federal bench in the Northern District of Georgia. He is bright, thoughtful and decisive. He is an excellent judge for complex civil litigation. He is also very easy to work with in terms of scheduling. He seems to remember what it was like to practice law, which is refreshing in a judge these days.

Pro defense and pro government. I filed pro se, forma pauperias and asked for protection against the defendant. The court ordered that the defendants not be served so that I could not seek a restraining order. Therefore, I am being harrassed while attempting to prepare for his fivolity determination which I know is going to be biased although I filed affidavits of witnesses and defendant is not present on his order. When I questioned why 4 of my cases that are unrelated were assigned to this judge I was told that all cases from Newnan are assigned to him as the presiding judge which I believe is false. If any of you have cases that were not assigned to him in Newnan Georgia Division previous to my filing on march 20, 2012 please advise.

I have never in my life encounter an unfair judge as this one. He is very biased cruel judge. This judge allows his personal relation along with personalfeeling get in the way of doing what is right and the law. He makes up punishments because he is allowed to do so. He isn't a judge of the law he is the judge of what. I set in on his cases and not only did he allow personal feelings of the plaintiff allowed in the court without any evidence. Once the defendant give evidence not just one time but through out the whole trial he said he never seen of it. This judge is so far from the law. Now I see George Bush give him this role. No wonder this is the most unfair judge I have seen in Georgia But I am sure it's more.

My wife was sued by the FTC in 2008 for nothing that her company did but for what one of her partners did at another company. Judge Batten issued an 'ex parte temporary restraining order with asset freeze'. Without hearing the other side or giving any due process he ordered all of our assets frozen. No money to pay for lawyers and only $3000 for living expenses. The receiver he placed to take over consistently lied under oath and Judge Batten ignored this. He has made more money than he has given back to the consumer. Thats because no one was ever out any money. When it came down to personal assets I only got my half. There was less than $50,000 equity in the house but he ordered me to pay $56,000 for my half or sell the house. After selling and paying fees there will be less than $40,000. This guy is bad news. He can't add either. Oh, the FTC claimed that my wifes agents were 'talking too fast on the phone.' And though everything I have worked for in the last 30 years is gone, I have never been in the man's court room.

Maybe the worst judge I've come across in 23 years of practicing in federal courts around the United States -- and that's saying something. Once, he actually ordered that defense counsel serve discovery 7 days before the discovery cutoff and then, to ensure it would be answered, ordered that the plaintiff's response time of 30 days be shortened to 7 so that the defense would get their discovery. What made Judge Batten's order even more remarkable was that the defense lawyer did not even ask for this relief -- Judge Batten just decided it would be a good way to help the defense. As far as motions go, his M.O. is to issue one-sentence orders even for substantive motions -- which violates the standard of every circuit that a judge must at least minimally explain what his/her reasons were for the order so the appellate court can review the order appropriately. Bottom line: this guy prejudges cases and then sets out to punish the side he thinks should lose -- over and over again.

We asked for a jury trial. Not only was it denied, but it took this judge eight months to make a decision based on this case - as it turned out, an incorrect decision, when all we kept asking for was to let a jury decide. When he first received our case, it was transferred from Clarence Cooper, who is a much fairer and more impartial judge.
