While my opinion is high for Judge Simandle for only his court room organization temperament, punctuality, and he is very intelligent, I have little respect for his unwillingness or rather willing to mitigate awards without regard to litigates and basing his feelings(biased of his own opinion is my opinion)_ and opinions into law. His outright dislike to my case was also an embarrassment to his honor and to the attorneys of both sides. His input of ill feelings toward my case was put into his statement of law when it came down to a jury award and the instructions. He was unwilling to allow a jury make their own conclusion and then he could have ordered remittitur. But rather he put his law opinion of award for the jury. Pushed for a settlement and afterward the jury was questioned by both parties. The jury found exemplary evidence in their opinion, of course prior to deliberation, but it was unanimous during our talks they wanted to award much more. A lot more then the judges stated award that was only being allowed to be considered. So although i won, i felt forced into a settlement not withstanding the Judges intentions was to reduce then anyway, any award the jury would have put forth more than Judge Simandle's allowance. The jury seemed disappointed as well. When Judge Simandle asked the jury his questions, you could see his 'surprise in his eyes and tension and confusion. His demeanor changed for the first time. He is very level tempered and shows little emotion... Very little humor if any at all. His own humility, i feel, gets in the way of the litigants and feel it his time for retirement. I won but should have been deserved more and so did the jury. May be the last time the Judge allows discussions with jury after settlement, unless his more sure they will side with his own opinions and the jury not allowed to be of their own... I could not find his fairness to understand and bias his own opinion into law and prerequisite such to the jury and if anything other than what his determination of an award was given, he would have reduced. And made it clear.
