He shouldn't be on the bench. In the patent context, he has very, very heavy biases towards patentee plaintiffs, and he does everything he can to make sure they win. It's not too much to say that he's corrupt. In addition, his temperament is terrible: imperious, snide, short-tempered.. He's one of the worst judges that I've ever tried a case in front of--and we won. I've not appeared before him in the criminal context. The ED Tex has a mafia of ex-judges who run settlement discussions and they leak information back to the judges--totally inappropriate. On the plus side, he works hard--except that his hard work is done with such a bias that he's effectively corrupt. He essentially ignores the Federal Circuit.
