Judge McMahon seems more interested in playing favorites with the attorneys that she sees as influential (possibly to her future) than with listening to the arguments on the merits. In our case, she based her final opinion on an entirely novel line of reasoning, arrogantly boasting that her approach (which seems entirely wrong to us) had not been briefed by either side. There are many judges that are smarter than most of the lawyers that appear before them. I think that Judge McMahon's tragic flaw may be that she thinks that she is one of them.
