Generally decides matters on the papers, so I've never actually argued a motion before him. Takes things off-calendar the Friday before. I have to agree with the comments that Fees appears to judge the parties at the outset, and if your client is on the wrong end of that assessment, you do not seem to get a fair shake. That's the way it was in my case, and apparently others feel the same way. This judge was more willing to reach what he thought was the right outcome regardless of the legal niceties that would derail that outcome. We'll see how he fares on appeal.
