He lacks scholarship, and will often practically cut and paste the defendant's argument. Temperamentwise, he is truly a bully. With a life tenure and no worries, he should not feel the need to brow-beat or insult counsel. Constantly interrupts counsel, at times just to insult them. Clearly a conservative-activist (like most of his colleagues in the 4th Circuit), unscholarly (this is where he differs, at least his pro-business colleagues are legal-minded), bully. In addition to having problems fully grasping the law, he does not posses a high level of factual comprehension. Moreover, he seems unable to view facts in a plaintiff's favor if he personally disagrees with the case. Most of his colleagues at least make an effort to appear respectful of counsel). At the end of the day, he is just a schoolyard bully.
