I was before Judge Ellis for a number of years on a series of interconnected, complex fraud cases. My 'batting average' with him on motions was probably less than .500, and sometimes I thought his decisions were very far off in terms of the law. But, even when he ruled against me, I knew he had given me a full hearing and was doing what he felt was right from a legal perspective. And he always treated all counsel with infinite respect. I have no truck for Madoff but looking at the facts and applicable law I think Judge Ellis's decision was the correct one, and because I believe him to be a man of great integrity and compassion, also think the decision was not an easy one for him. Those who blindly criticize Judge Ellis for this decision should understand their true quarrel is not with him but with the applicable law, and if the highest calling of any judicial officer is to stand between the defendant and the mob, history will record that Judge Ellis has not just honored his oath but honored his office. It would be a privilege to appear before him again.
