A real whopper of a case finally reversed by 4th circuit. Unions vs Prince George's County. Judge Williams was unanimously reversed by the 4th circuit. He awarded the union SUMMARY judgement on the contract clause claim. He ruled that (1) the furlough plan impaired the CBAs, (2) such impairment was 'substantial,' and (3) it was not 'reasonable and necessary. Basically saying that the unions had to approve any furoulgh attempt by the county. The 4th circuit outright rejects the proposition that the furlough plan impaired the CBAs. An easy call the Judge should have been able to discern.
