From this judge's opinion on summary judgment, it appeared that he wanted to rule for the school district regardless of the law. The opinion was sloppy and unjustified. It appeared that this judge had advance knowledge of an impending 3rd Circuit decision which would undermine his intended rationale, so he found a ridiculous one (not supported by the law, and contrary to the 3rd Circuit's other recent decisions) to justify his unchanged decision.
