I am writing to formally express concerns regarding the actions of former Chief Judge Timothy C. Batten, which I believe represent a significant injustice within our legal system, particularly concerning the treatment of African American individuals and businesses. The case PureO v. Loc N Products, Case No. 23-cv-03917, exemplifies a troubling pattern of misconduct that merits scrutiny.

In this case, Judge Batten denied over 400 ownership exhibits presented by our company, which fundamentally undermined our defense and created an unjust record of no contest. This ruling resulted in a summary judgment in favor of a Nigerian company, effectively transferring ownership of our brand without due process. According to established legal principles, as articulated in Lennon v. Sweeney, 101 F.3d 777 (11th Cir. 1996), summary judgments are permissible only in instances where there is a clear failure to respond to the complaint or when there is no genuine issue of material fact. The evidence we provided was substantial, and the dismissal of our exhibits raises serious concerns about the integrity of the judicial process.

Furthermore, it has come to light that Judge Batten may have made these determinations based on prior assurances made to the Nigerian company and their legal representatives from Alston & Bird, specifically regarding the avoidance of a jury trial. This raises significant ethical questions under the Code of Conduct for United States Judges, which mandates that judges must avoid impropriety and the appearance of impropriety in all activities.

Our commitment to preserving our Black-owned brand is unwavering, and we believe that the actions taken in this case reflect broader systemic issues within our judiciary that must be addressed. The retirement of Judge Batten, reportedly in response to complaints filed with the Department of Justice (DOJ), indicates an acknowledgment of the seriousness of these allegations.

We respectfully seek justice and a thorough investigation into these matters to ensure accountability and uphold the principles of fairness and equality within our legal system.
