Judge Der-Yeghiayan's ruling on summary judgment motion went up to the Seventh Circuit Court of Appeals and was affirmed. The plaintiff in the action was granted Certiorari. The Supreme Court affirmed the Seventh Circuit and Judge Der-Yeghiayan's decision. Judge Der-Yeghiayan's decision in Wallace v. Kato will certainly reduces the number of frivolous lawsuits being filed. Nice to have a Judge who will make a stand.
