Easy way for PLAINTIFFS' lawyers to deal with this judge: He wrongly grants 12(b)(6) motions and wrongly denies leave to amend. Just suggest to defense counsel that they should file a 12(b)(6). By the time you get back from the Ninth Circuit, he will be retired. (He's 88 years old.)
