Noel refused to uphold civil procedure by allowing defendants to play hide the ball during discovery. Defendants were an entrenched special interest group and third parties produced evidence that documents produced by defendants were incomplete and missing smoking gun emails, had repeatedly attempted to delay and withold documents, and had violated civil procedure. Noel refused to enforce civil procedure after countless motions to compel and eventually the case was dismissed for lack of evidence.
