'The government fails to provide sufficient evidence that any potential future dissemination of Madoff's assets would rise to the level of an economic harm.' So, it sounds like Judge Ellis doesn't exactly trust Madoff not to continue violating the terms of his bail - he only believes that Madoff has wiggle room in complying with those terms and has not as yet reached the point where it requires sanction. Reminds me of the F. Scott Fitzgerald quote 'The very rich are different from us...' Judge Ellis seems to understand that concept perfectly and has no hesitation in applying it from the bench.
