Judge Benitez is exemplary of the kind of judge we should aspire to seat on our courts. He rules based on logic and the law rather than convoluted mental gymnastics to push an agenda. It is shocking to me that it has taken nearly 20 years, and more than ten years since Heller for a judge to start ruling against California’s unconstitutional infringements on Second Amendment Rights. His ruling finding CAPC32310 unconstitutional rightly criticized Bacerra’s cavalier use of heresay rather than evidence in support of California’s infringements, which is emblematic of California’s disregard for the rights of its citizens. His judgement lays out clear and logical reasoning (with cited factual incidents supporting it even) for his finding, something that hasn’t been seen in a ruling on a Second Amendment case in California in far too many years. If we had more judges like Benitez on our courts perhaps California wouldn’t be in the sorry state it is today.
