While the attorney involved may have made a technical error in relation to the labelling of discovery, Judge Davis apparently cannot count from 500 to 1,000. The defense in this particular case have filed six motions for summary judgment. All six motions were denied by Judge Davis. 06/28/07 – Unfortunately, Judge Davis has literally stamped his bench ruling with a final opinion. ... P's are at this time preparing an appeal, wherein P's are rather certain to prevail. Ps firmly believe that the misrepresentations and omissions of D's will anger a new Jury against D's when a new trial is scheduled and hopefully in a different venue.
