Recent decision (14-1270) by 1st Circuit overturned Judge Ponsor class action cert for many being held for deportation. 'we reject the 6 month presumption underlying the class certification and judgment, the class action is REMANDED for reconsideration of the certification order in a manner consistent with this decision' Judge wanted all held for 6 months to be released. Sorry lefty judge. Each requires a separate case by case Individualized review.
