Judge Tuauro did the Commonwealth a real service in the 1970''s with his consent decree that people with retardation have the same rights as as people without this disability. Before they were kept in overcrowded state institutions and housed in horrid conditions. But It is apparent that Tauro showing his age in this particular ruling.
