In Alves v. Hewlett-Packard he was part of the panel that decided the case with an unpublished memorandum opinion that affirmed the denial of disability benefits to a man who could not sit for more than 4 hours a day. The law is clear that such a person is totally disabled (Armani v. Northwestern). He was able to accomplish this seemingly impossible feat by denying the existence of the law that both sides recognized. He has a history of denying disability benefits in unpublished memorandum opinions 100% of the time.
