This judge is very intelligent but rarely shows it. He loves jazz and from what I understand, is fairly accomplished as a musician. I agree with the comments below, particularly from criminal defense counsel, having had several cases before him. In one case, we had solid grounds for a downward departure for probation or home confinement, which he rejected; but he found a way to soften the sentence. Of course, by doing so, he knew that any appeal would be a waste of time. Moreover, who wants to appear before him again on re-sentencing?
