A disaster. He is smart but so pro-government getting him in a criminal case is a disaster. And god forbid you get him reversed in the Circuit. You will learn your lesson in your next appearance. Short tempered, completely inflexible about scheduling no matter what the reason. Just a nasty man.

Judge Whyte gets an early 'smell' for the case, and you'd better hope that it's a favorable odor for yours. Takes that early impression and runs with it; if you're on the wrong side, you've got little chance. Typically fair with lawyers but can occasionally get testy. Works hard and turns out opinions quickly, but they are often ill-reasoned because of his 'smell test.'

Judge Whyte is willing to come up with off-the-wall interpretations of consumer protection statutes that he doesn't believe in.

If you have a section 1983 case and represent the plaintiff, you would be wise to stipulate to a magistrate judge to hear your case.
