UNITED STATES OF AMERICA, v.MICHAEL D. CAMISCIONE, Defendant-Appellee. No. 08-4294 Appeal from the United States District Court for the Northern District of Ohio at Akron. Ann Aldrich, District Judge. Camiscione pleaded guilty to a one count possession of child pornography, in violation of 18 U.S.C. § 2252 (a)(4) and (b)(2). Although the Sentencing Guidelines recommended a sentencing range of 27 to 33 months of imprisonment, the district court sentenced Camiscione to the custody of the United States Marshal’s Service for the remainder of the day, followed by three years of supervised release and 180 hours of community service. Gov’t properly appealed and 6th circuit, twice now, vacates sentence and remands for resentencing. Seems like Judge Aldrich has a soft spot for this individual. She empathizes with his, shyness, loner status, and lack of a girlfriend as mitigating factors. So she continues to deviate 99.9% from sentencing guidelines. She also slow rolled the case for over a year. Now the same offense would mandate mandatory 60 months in prison. Apparently she is afraid of what might happen to him in prison. This empathetic Judge doesn’t deserve a third chance. Less than ONE day of jail time, one day! 6th circuit should have just resentenced this predator to 27 months and been done with it. Remanding to a Judge like this is a waste of time.
